Wood, Herron & Evans LLP is pleased to announce that Scott Guttman has joined the firm as an attorney in the Mechanical & Aerospace Practice Group. Scott advises clients on all aspects of intellectual property law, mainly focusing on patent preparation and prosecution in the U.S. and internationally. His practice includes patentability, infringement, and clearance investigations, as well as developing strategic plans to enforce and defend patent and trademark rights. Scott has experience in various industries and technologies, such as medical devices, oil and gas, firearms and optics, aerospace parts, molded containers, and consumer goods. He also guides clients on design patent applications and cost-efficient strategies to maximize IP protection and meet business goals. Scott is admitted to practice in Ohio, Kentucky, and before the U.S. Patent and Trademark Office. He earned his J.D., cum laude, from the University of Cincinnati College of Law, and holds dual undergraduate degrees: a B.S. in Mechanical Engineering from Indiana University–Purdue University Indianapolis and a B.A. in Mathematics from Butler University. “Scott’s technical background and IP experience strengthen our ability to provide comprehensive, strategic counsel to clients with complex mechanical and aerospace technologies,” said Glenn Bellamy, Partner at Wood, Herron & Evans. “We are thrilled to welcome him to the team.”

On February 21, 2023, our colleagues Ken Germain and Lou Sitler hosted a lively virtual discussion with our CincyIP community of IP practitioners on the topic of the Constitutional implications of the industry standard of “stacking” (concurrently or consecutively) IP protections for nonfunctional designs with both design patents and product design trade dress. Ken and Lou examined the origin, nature, and meaning of these two types of IP protections in the context of their two Constitutional bases—the Patent/Copyright Clause and the Commerce Clause—and provided thoughtful analysis concerning the Constitutional compatibility of these protections. He focuses his practice on expert witness work, consulting and litigation, including Early Neutral Evaluation. Ken often has been retained as an Expert Witness on issues relating to trademarks and unfair competition, working on cases involving some of the nation’s largest companies in high-stakes, cutting-edge cases. He has testified in court over 15 times. Lou Sitler counsels clients on all aspects of intellectual property law, with a primary focus on patent matters including U.S., international, and foreign patent preparation and prosecution, as well as patentability, infringement, and clearance investigations.
